Terms & Conditions

  1. These terms and conditions form and govern any order entered into between the customer and James Shutters. No other terms and conditions shall apply. References to goods shall mean any product supplied and subject to the aforementioned order.
  2. The order has been willingly entered into by both the customer and James Shutters. The order will be deemed to be accepted by James Shutters unless the customer is notified to the contrary within seven days.
  3. The customer has the right to cancel within seven days of the order being placed.
  4. The order is subject to a technical survey, the measurements from this produce the final dimensions for manufacturing. Since the goods are made to every customer’s individual requirements, the order cannot be cancelled once the manufacturing process has begun.
  5. An order can only be accepted with the deposit as specified on the order and the balance becomes due upon the completion and or fitting of the goods, or in the event of cancellation or refusal as the case may be.
  6. Risk in the goods passes upon delivery and or fitting, butt title will only pass to the customer upon receipt and clearance of full payment.
  7. Fitting dates will be given upon receipt of the manufactured goods. A guide to our usual lead time is approximately 8 weeks from an order being placed, this can vary and can be dependent upon many factors and therefore is not a term of the agreement. James Shutters shall have no liability for failure of the goods due to damage or defect that is caused by circumstance beyond reasonable control including, but limiting to: industrial dispute, system or network breakdown, explosion, natural disaster, act of terrorism or war.
  8. If payment of the purchase price of the goods is withheld beyond the terms set in clause 6 then interest shall be payable, on a daily basis at a rate of 4% per annum above the prevailing rate in force of the National Westminster Bank PLC.
  9. No liability under James Shutters guarantee shall arise unless the purchase price has been paid in full on or before the delivery and fitting of the goods.
  10. James Shutters guarantee the shutters for a total period of five years. Should any defect in material or workmanship occur within first three years of the delivery and fitting James Shutters will repair or replace the goods, or affected parts of the goods without charge for labour or materials, providing that the goods have not been modified or subjected to any misuse, during the 4th and 5th year the labour will be chargeable whilst the other terms remain the same.
  11. The products are sold as an internal window dressings and are made from a natural wood or wood compound. The buyer therefore accepts that minor imperfections found in the goods, not visible to the human eye in normal light, at a distance of 1.4 metres will not be considered defective. Colour matched paints cannot be guaranteed to be a precise exact match although every effort in accuracy will be made to the finished product. The goods are not guaranteed against extreme damp or humid conditions or extremes of variation. It is usual that a customer’s window or installation site is not true or square and some adjustment may be necessary to fit the goods.
  12. Our products are subject to improvement or modification from time to time and therefore may have slight variations from printed materials, samples, displays or electronic medium.
  13. This agreement is subject to English law and the exclusive jurisdiction of the English courts. Nothing in these terms and conditions shall affect a customer’s statutory rights.
  14. In the event of cancellation within the 7 day cooling off period, please write to the registered office, attaching a copy of the order and post using recorded delivery also e-mail James Shutters ensuring that an automatic reply feature is activated upon opening e-mail.
  15. In the case of any accidental damage James Shutters reserves the right to undertake any repairs deemed necessary.
